Both parents and the guardian had breached their statutory duties of care to the child.

The Alicante Provincial Court has sentenced parents to four months in prison for the truancy of their son, after he failed to attend class for almost two years during the school years 2007-08 when he was just 13 years of age.

The child regularly played truant during the 2006-2007 academic year, attending for only five days during 2007-2008. He was subsequently admitted to Alicante’s Juvenile Reception Center on June 6, 2008.

A third defendant in the proceedings, was the boy’s football coach with whom he lived for almost a year and who, it was said, also neglected to send him to school, whilst he was in his care. He too was sentenced to the same term as the parents.

The judge said he said he was issuing a custodial sentence to both parents and the guardian for a crime of failing to fullfil their parental obligations together with the breach of their statutory duties of care to the child.
