KEY ORIHUELA BUSINESSMAN GIVEN 35 YEARS IN PRISON

Orihuela businessman Angel Fenoll has been sentenced to thirty five and a half years in prison for crimes against the Treasury and necessary cooperation in a continuing crime of forgery by the courts of Orihuela.

Fenoll, who is also implicated in the infamous Brugal case, which is linked to a number of members of Orihuela´s Partido Popular, including former Mayor, Mónica Lorente. A witness testament in a court hearing in 2007 stated that Fenoll played a “decisive part” in the municipal campaign that led to Monica Lorente becoming mayor of Orihuela in 2007.

After a delay in start of the case in March, Fenollwas tried along with 17 other defendants for allegedly falsifying 1,330 invoices on behalf of the companies Colsur Sl y Proambiente SL., with the sole intention of avoiding tax.

The judge convicted Fenoll of 11 offenses against the treasury, imposing an additional penalty of “up to four times the amount defrauded in each of the offenses referred to” as well as the loss of the possibility of obtaining grants or tax incentives or Social Security.

The prosecutor had asked for 36 years in prison for the businessman, who had acted “in order to hide the true result of the activity” of those two companies, “for the purpose of defrauding the Treasury” and evading payment of the VAT and corporate tax for the years 2002, 2003 and 2004, by using specific statements so wrongly deduct expenses and fees of VAT “using fictitious invoices that had been completely made up” in order to document “benefits or services” which had not been made.

The total prison sentence handed down was for a combined 177 years between the defendants, one of whom is a former PP councillor of Albatera, Francisco Javier Bru.
