The Supreme Court has overturned the decision made by the Valencian Department of Health insisting that health workers retire when they reach the age of 65. The ruling says that the Department was wrong in not allowing them to remain active beyond this age.
An estimated one thousand professionals have been affected by this regulation which was adopted without prior negotiation with the unions. Those most affected are doctors, as they often ask to extend their activity up to 70 years of age.
The decision by the court means that approximately 165 physicians now have to be reinstated into their jobs and any salaries that have been lost as a result of their forcible retirements have to be repaid.
Rafael Cantó, President of the CSIF, said that the ruling actually affects about a thousand professionals in the Region of which there are 165 physicians who can return to their jobs, and are now able to continue practicing up to 70 years of age.
