The Provincial Court of Alicante has sentenced a man to two years in prison for sexually assaulting the granddaughter of his romantic partner, a minor who was seven years old when the events occurred in the Alicante municipality of Javea. The sentence, handed down by a court of the First Section, considers it proven that the events took place in August 2023 in the home where the accused lived with the victim’s grandmother.
According to the ruling, the man took advantage of a moment when he was left alone with the minor to ask her to lie down on the sofa with him under the pretext of giving her a massage. Afterwards, he began to touch her.
The accused confessed to the actions
The defendant himself recognised the sexual assault when giving a statement before the courts of Denia on 27th March 2024. Subsequently, at the start of the trial held on 30th June, he accepted responsibility for the crime after reaching a conformity agreement with the Prosecution.
Under this agreement, the court has imposed a two-year prison sentence for a crime of sexual assault on a minor under 16 years of age. The Court applied the mitigating factors of confession and repair of damage, as the accused had deposited a financial amount before the trial to cover compensation.
Probation and a restraining order
The sentence also establishes the payment of compensation of 1,500 euro to the parents of the minor. In addition, it imposes a five-year probation measure on the convicted man and prohibits him from approaching within a minimum distance of 300 metres of the victim for six years.
Finally, the court has agreed to suspend the prison entry for a period of three years, on the condition that the convicted person does not commit any further offences during that period.
The sentence is final and no appeal can be made against it.
