A lawyer in Elche is facing three years in prison after being accused of misappropriating 65,000 euro from a client’s compensation. The funds were intended for a woman and her young daughter following a serious road traffic accident. The trial is set to determine if the legal professional kept the money, which was meant to cover injuries and lasting effects from the crash.
The incident dates back to November 28th 2018, when the mother and daughter were involved in a significant collision. Due to the severity of the impact, the young girl was hospitalised for several months. Following the accident, the accused reportedly contacted the mother, presenting himself as a specialist in road traffic claims, and offered to represent the family against insurance companies and responsible parties.
The woman granted the lawyer power of attorney, allowing him to manage all legal proceedings and collect payments on her behalf. However, the prosecution alleges that as the insurance payouts were issued, the lawyer received the full amounts but only passed on a fraction to the victims. It is claimed that he kept the remaining 65,000 euro for himself without the knowledge or consent of the mother.
The Seventh Section of the Provincial Court of Alicante, based in Elche, will hear the case today, Thursday, May 7th. The court will examine the financial records to establish whether the retained funds were an act of illegal appropriation or if they related to professional fees and expenses. If found guilty of misappropriation, the lawyer could be sentenced to prison and ordered to repay the full 65,000 euro to the mother and daughter.
