A man has been sentenced to 72 and a half years in prison by the Second Section of the Provincial Court of Alicante for abusing several minors and recording them performing sexual acts at his request. The individual was also convicted of storing and sharing child pornography.
The court found him guilty of nine offences of producing child pornography, five offences of sexual abuse of a minor—two involving penetration—nine offences of exhibitionism, and one offence of possessing and disseminating child pornography.
In addition to the prison sentence, he is disqualified from engaging in any paid or unpaid profession or trade that involves regular and direct contact with minors for a period five years longer than his custodial sentence.
The ruling considers it proven that, between February and April 2021, the convicted man used a live video chat application to contact girls under the age of 16. He engaged in conversations of a sexual nature with them, exposed his genitals, and performed sexual acts. During these calls, driven by the intention to satisfy his lustful desires, he persuaded the minors to perform specific sexual acts in front of the camera.
In January 2022, following confirmation that paedophilic files were being downloaded and shared from an address in Alicante, officers entered and searched both the man’s home and a commercial premises where he worked in Alicante.
Law enforcement officers seized a computer, two phones, a hard drive, and several USB drives. On these devices, they found more than 2,000 pornographic files, photographs, and videos depicting naked minors—some under ten years of age—in sexual and degrading situations or engaged in sexual relations.
Among the seized data were numerous screenshots of live video chats showing the convicted man exposing himself to minors while conversing with them. The written transcripts of these chats demonstrated a direct link between the propositions made by the man and the actions subsequently performed by the girls.
Classifying the acts as sexual abuse of a minor under 16 years of age, the Alicante Court cited Supreme Court jurisprudence. The ruling noted that sexual integrity can be violated without physical contact between the perpetrator and the victim when the offender incites, promotes, guides, or conditions the minor to perform such acts.
The sentence establishes a maximum effective prison term of 20 years. The ruling is not final and may be appealed before the Civil and Criminal Chamber of the High Court of Justice of the Valencian Community.
