The defendant has also been handed a two-year restraining order preventing him from approaching the victim. He originally faced a trial request from the prosecution service for two years and four months in prison, alongside 6,000 euro in compensation for emotional distress. However, his defence lawyer, Aitor Navarro García, reached an agreement with the public prosecutor to reduce the charge by applying the mitigating factor of damage repair after the accused paid 1,000 euro to the victim prior to the trial.
The sentence, handed down last July by the presiding magistrate of Section 4 of the Criminal Division at the Alicante Court of Instance, established that the events took place at around 2.15pm on 1st July 2024 in a well-known hotel in Alicante. The defendant, who had no prior criminal record at the time, was staying in a room entered by an employee of the establishment.
The floor maid was unexpectedly approached by the guest, who grabbed her breasts without her consent and with sexual intent, whilst making a sound of satisfaction. Because the defendant paid 1,000 euro for the damages caused before the trial took place, the victim made no further financial claims, according to the court ruling.
