The public transport service linking Torrevieja and Alicante has been put out to tender for a definitive contract, but the bidding process has already been suspended due to an appeal.
The announcement comes from Avanza, the current operator under emergency contract CE-704, which was recently annulled by the Central Administrative Tribunal for Contractual Appeals (TACRC). Clarifying the situation, the bus company stated that although the deadline to submit bids for the new tender has now closed, the competitive process is frozen while the latest legal challenge is handled.
The initial emergency contract was struck down after the tribunal upheld an appeal filed by competitor GTV. The ruling determined that regional authorities had failed to adequately prove an imminent threat of service disruption that would justify using emergency direct assignment rules.
Avanza pointed out that although the legal framework used was a direct award, regional officials had originally invited proposals from three separate transport firms, with Avanza being the sole provider to submit an offer. Furthermore, the tribunal noted that reliance on temporary emergency measures had exceeded the strict two-year limit set by European legislation, ruling that such procedures cannot be continually extended to replace standard public tenders over prolonged periods.
