The Provincial Court of Alicante has sentenced a man to two years in prison for sexually assaulting his niece when she was between eight and nine years old, in events that occurred between 2015 and 2016 in Alicante. The accused was also convicted of showing pornographic material to the minor, with whom he lived in the family home alongside the girl’s mother and grandmother.
The defendant admitted to the facts and assumed responsibility for both offences after reaching a conformity agreement with the Prosecutor’s Office at the start of the trial, which was held on October 2nd. According to the proven facts established in the judgement, the man showed the girl a pornographic video in his bedroom with the intention of satisfying his sexual desires.
Following the incident, he proposed playing in the manner shown in the images. The ruling notes that although the minor initially complied, she ran away when the accused undressed, got into bed, and asked her to join him. The victim, who is the daughter of the defendant’s sister, began experiencing symptoms of anxiety, insomnia, and nightmares as a result of what happened and formally reported the incidents when she turned 16 years old.
The court has imposed a two-year prison sentence for the offence of sexual assault against a minor under the age of 13. However, this prison sentence has been suspended for a period of four years on the condition that he does not reoffend during that time. Additionally, the tribunal added a 12-month fine with a daily rate of 4€ for the second offence of exhibiting pornographic material to a minor.
The judgement also establishes that the defendant must compensate the victim with 6,000€ for the moral damages caused, to be paid in monthly instalments of 150€. Furthermore, the court has issued a restraining order keeping him at least 500 metres away from the victim for five years, alongside five years of supervised liberty.
