The Anti-Corruption Prosecutor’s Office has dismissed a complaint for malfeasance filed by neighbourhood leaders against the mayor of El Campello, Juanjo Berenguer; the Environment Councillor, Marcos Martínez; and a senior municipal official from the Urban Planning Discipline department.
According to a statement released by the City Council, the Anti-Corruption Prosecutor’s Office has closed the case filed nearly a year ago by Vicente Calpena Aureliano and José Luis Valdés. The Alicante Anti-Corruption Prosecutor’s Office highlighted that no evidence of criminal activity has been found, noting that the information presented clearly demonstrates a lack of supporting evidence to support the claim of malfeasance.
Both complainants stated at the time, in August and September 2025, that they were filing the complaints individually. They considered that the two politicians and the technician had maintained an attitude that could constitute a crime of prevarication due to what they viewed as inactivity regarding the discharge of wastewater onto public roads from a tourist residential complex.
The Anti-Corruption Prosecutor’s Office accepted the complaints and has decided to close them after receiving reports from the City Council. These reports confirmed the initiation of several sanctioning proceedings against the tourist complex for the spills, which have since been resolved after the required works were carried out. The resolution dates from December 2025, just three months after the complaints were made, but the Mayor’s Office of El Campello has only become aware of it this week.
The complaints directly accused the mayor, the councillor, and the senior official of committing the crime of malfeasance by omission, a criminal offence where a public official incurs criminal liability by failing to act when obligated to do so. The complainants alleged that the three individuals may have favoured the company operating the tourist resort, an allegation later confirmed to be false.
The prosecutor’s ruling is unequivocal and orders the dismissal of the criminal investigation proceedings, without allowing for the filing of a complaint or lawsuit, as the reported facts do not provide sufficient evidence of criminal activity. The prosecutor emphasised in the final line of the ruling that the dismissal is final, and no appeal is possible.
