The Alicante Court condemned a 45-year-old father of Peruvian ancestry to two years in prison, with the option of avoiding imprisonment, after admitting to sexually assaulting his own 8-year-old son after spending Christmas Day 2022 with him.
The events occurred when the defendant and his son were driving back to the home of the child’s mother, the defendant’s ex-partner, in the back seat of a friend’s vehicle.
According to the penalty handed down by a Second Section court, the child urged his father to stop, to which he answered, “We are men,” but the minor informed his mother, who went to the Police Station two days later to file a complaint.
Acknowledgement of sexual assault
The accused admitted to the sexual assault at the outset of the hearing on April 1st, after striking a plea deal with the Prosecutor’s Office, and he had already deposited 2,000 euros to cover potential compensation.
Thus, in light of the acknowledgement of the facts, the court issued a judgement of conviction ‘in voce’ in which it considered the defendant the perpetrator of a crime of sexual assault against a minor under the age of 16 and imposed two years of imprisonment using the incomplete exemption of intoxication, because it had been established in the agreement reached between the parties that the accused acted under the influence of his alcohol dependence.
The verdict prevents him from seeing his kid within 300 metres for four years and imposes a five-year supervised release period, as well as agreeing to a four-year suspension of parental rights and a compensation payment of 7,000 euros.
The court suspends the prison term for four years on the condition that the accused does not reoffend and continues his alcohol recovery therapy in a final sentence.
