A 23-year-old man who sexually assaulted his mother’s adolescent cousin in the home where he lived in Alicante has been given a six-month prison sentence.
The events happened in the early morning of April 2nd–3rd, 2022. The Alicante Court’s judgement says that the offender went into the victim’s bedroom with two of her sisters, who were also minors, after going to a birthday party.
At that point, the accused went up to the youngster and instructed her to look him in the eye. Then he kissed her on the mouth without her permission, which made her hesitate for a few seconds because she didn’t know what to do.
The female finally pushed him away. According to the verdict, she then went to the toilet, rinsed her mouth and face, and stayed there to calm herself.

When she came out, the defendant was waiting for her at the door without a shirt on and asked her what was wrong. The girl ran away from him and returned into the room with her sisters. She climbed into bed to go to sleep.
The defendant went back into the bedroom and kept asking the same question until he finally went back to his own room. He saw that the kid was pretending to be asleep and wouldn’t answer.
The next morning, the victim told his parents what had happened, and they went to the police station to make a report.
Admitting facts in court
The defendant, who is from Paraguay, admitted to the facts at the opening of the trial on March 24th, after making a deal with the Prosecutor’s Office.
So, the court found the accused guilty “in voce,” which is now written down. The accused is now seen as the person who sexually assaulted a youngster under 16 years old.
The forensic medical report that his defence provided also says that he has a moderate intellectual handicap that may have been caused by prenatal hypoxia. The Alicante Provincial Court believes that this diagnostic means that the defendant’s mental and willpower abilities are generally lower.
The sentencing says that the defendant must pay the youngster 300 euros for the moral damages caused, and that he must stay at least 500 metres away from her for the next five years, in addition to the six-month prison sentence.
He is also on supervised release for the same amount of time and can’t work in any field that requires him to have contact with minors for five years and six months.
There is no way to appeal the court’s decision.
